PLAZA BESPOKE TERMS & CONDITIONS

Please read these terms and conditions ("Terms") carefully before placing an order with Lupo Plaza LTD ("we," "us," or "our"). By purchasing bespoke luxury car air fresheners from us, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from placing an order.

 

1. Order Placement and Acceptance

   1.1. All orders are subject to acceptance by us. We reserve the right to refuse or cancel any orders at our discretion.

   1.2. By placing an order, you represent and warrant that you either own or have permission to use all assets such as logos, fonts, designs, and branding provided to us for customisation.

   1.3. The customer will work with us to create a design and finalised print file. When the customer agrees to proceed with the final print file, they enter into a legally binding contract with us under these terms and conditions.

 

 

2. Fragrance and Design Disclaimer

   2.1. The final print file will state that the fragrance oil used on the products may potentially darken, lighten, or tint the products' overall colour. This is a normal and natural occurrence, and by agreeing to the print file, the customer acknowledges and accepts that this may happen. They agree that they cannot request a refund or compensation if this occurs.

   2.2. The print file will also mention that the design can be moved relative to 1mm either side from the print file due to the printing process and the nature of producing multiple units. If any products deviate by more than 1mm, the procedure would be as follows:

      2.2.1. The customer should examine each unit and return the faulty units to us for inspection.

      2.2.2. Once we have completed our inspection, we will manufacture replacements for each faulty unit. This process may take up to 10 weeks. In the meantime, the customer can continue to use the products without any issues. Please note that this is not a regular occurrence, and this statement serves only to demonstrate the procedure taken to rectify the situation.

 

3. Scent Longevity and Strength

   3.1. The customer does not have the right to a refund if they believe the fragrance is not lasting as long as expected. Scent longevity and strength are intangible and cannot be measured precisely.

   3.2. Several factors, such as storage choice, environmental circumstances (e.g., above-average heat evaporating the fragrance oil faster), and product placement within the car's cabin, can affect scent longevity and strength.

   3.3. The customer may request proof of how much fragrance oil (in millilitres) was applied to their products. Standard products use 3ml of fragrance oil, and scent boost products use 4ml of fragrance oil (for reference).

 

4. Intellectual Property

   4.1. You agree that any content provided by you for customisation does not infringe upon any third-party intellectual property rights or violate any applicable laws.

   4.2. We reserve the right to refuse customisation requests that we deem inappropriate, offensive, or in violation of any laws or regulations.

   4.3. If we do proceed with your design and it infringes upon any intellectual property, you are agreeing that we have no liability as the responsibility lies solely upon you (the customer) to ensure the design is authorised.

 

 

 

5. Pricing and Payment

   5.1. All prices for bespoke luxury car air fresheners are displayed in pounds sterling (£) and are exclusive of any applicable taxes, fees, and shipping charges, unless otherwise stated.

   5.2. The customer is responsible for any additional fees or taxes related to receiving the products if the order is being shipped internationally.

   5.3. Payment must be made in full at the time of placing an order unless otherwise agreed upon in writing.

   5.4. We reserve the right to modify prices at any time. However, once an order is confirmed, the price will not be changed.

 

 

 

6. Shipping and Delivery

   6.1. We will make every effort to deliver your bespoke luxury car air fresheners within the estimated delivery timeframe. However, delays may occur due to unforeseen circumstances beyond our control.

   6.2. You are responsible for providing accurate and complete shipping information. We will not be held liable for any delays or losses resulting from incorrect or insufficient shipping details provided by you.

   6.3. Risk of loss or damage to the products passes to you upon delivery. Please inspect the products upon receipt and notify us immediately of any damages or discrepancies.

 

 

 

7. Returns and Refunds

   7.1. Due to the customised nature of our products, we do not accept returns or provide refunds unless the product is defective or significantly different from the specifications agreed upon, such as the 1mm design threshold mentioned earlier.

 

 

8. Ownership and Liability

   8.1. All intellectual property rights, including trademarks, logos, designs, and artwork created or used in relation to the bespoke luxury car air fresheners, shall remain the property of your own company. We do not reserve the right to manufacture, sell or distribute car air fresheners with your branding without your knowledge permission.

   8.2. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the purchase, customisation, or use of our bespoke luxury car air fresheners.

   8.3. Our total liability to you for any claim arising from these Terms or the products shall not exceed the total amount paid by you for the specific order giving rise to the claim.

 

 

 

9. Governing Law and Jurisdiction

   9.1. These Terms shall be governed by and construed in accordance with the laws of Great Britain.

   9.2. Any disputes arising from these Terms or the products shall be subject to the exclusive jurisdiction of the courts located in Glasgow, Scotland.
